Probate Services and Fees
Our fees are not the only costs associated with obtaining probate and administering the estate; there will be disbursement costs. Although, most costs will be deductible expenses from the estate at the appropriate time. We will handle the payment of the disbursements on your behalf also to ensure a smoother process under our estate administration service offering.
As with all of our pricing, we would like to give you transparency and certainty of the costs you incur. The following guide will help you to understand the services and related fees that are applicable when we support you with obtaining probate in uncontested estates where all assets are in the UK.
Likely disbursements that may be included are listed below and may include 20% VAT where applicable:
- Probate application fee – £155 (plus £5 for copies);
- Bankruptcy searches – £2 per beneficiary;
- Post in The London Gazette (protects against unexpected claims from unknown creditors) – approximately £150;
- Post in a Local Newspaper (also helps to protect against unexpected claims) – approximately £150;
- Death Certificate - £11 for a copy + £3 for each additional copy;
- Probate Grant - £1.50 per copy or £3 for a standing search if probate isn’t yet granted.
Other Potential Disbursements
In some situations, there are requirements for 3rd parties to get involved for additional expertise and ensure the competent administration of the Estate. Our time supporting on such additional matters would carry an extra management charge of £60/hour.
Accountancy fees; e.g.,
- Check the estate information is accurate;
- Check the will for potential issues;
- Check Land Registry records to establish whether a jointly owned property is owned as ‘Joint Tenants’ or ‘Tenants in Common’;
- Complete the ‘Return of estate information’ form (IHT205);
If there is no Will
- Searches & investigations may be required to find the legal next of kin and/or beneficiaries.
Legal fees associated with foreign assets
- A Grant of Probate in the country where foreign assets are held may be required and we would seek the expertise of a Probate Practitioner in the relevant country.
Legal fees associated with contentious Estates
- If any disputes arise, Clear Probate Limited would cease work until there is a resolution which may be facilitated with the help of a Contentious Probate Lawyer.
Legal & conveyancer fees associated with property in the Estate; e.g.,
- Fees associated with the disposal of a property
Financial Advisor fees, e.g.,
- If the deceased owned share holdings (stocks and bonds), we may seek the advice of a financial advisor as to the appropriate handling to protect the value of the Estate; such as the timing of a disposal.
